NESHAPs for Area Sources: Industrial, Commercial, and Institutional Boilers (Final)

This is EPA's final decision on the issues for which it announced reconsideration on 21 Jan 2015 pertaining to certain aspects of the 1 Feb 2013, final amendments to the "National Emission Standards for Hazardous Air Pollutants for Area Sources: Industrial, Commercial, and Institutional Boilers." EPA is retaining the subcategory and separate requirements for limited-use boilers, consistent with the February 2013 final rule. EPA is amending 3 reconsidered provisions: 1. The alternative particulate matter (PM) standard for new oil-fired boilers; 2. performance testing for PM for certain boilers based on their initial compliance test; and 3. fuel sampling for mercury (Hg) for certain coal-fired boilers based on initial compliance demonstration. EPA is making minor changes to the proposed definitions of startup and shutdown. This final action also addresses a limited number of technical corrections and clarifications on the rule, including removal of the affirmative defense for malfunction. This final rule is effective on 14 Sept 2016.
