Accidental Release Prevention Requirements; Further Delay of Effective Date (Final)

EPA is delaying the effective date of the Risk Management Program (RMP) Amendments for an additional 20 mo, to allow EPA to conduct a reconsideration proceeding and to consider other issues that may benefit from additional comment. The new effective date of the rule is 19 February 2019. The RMP Amendments were published in the Federal Register on 13 January 2017. On 26 January 2017 and on 16 March 2017, EPA published two documents in the Federal Register that delayed the effective date of the amendments until 19 June 2017. The EPA proposed in an 3 April 2017 Federal Register action to further delay the effective date until 19 February 2019 and held a public hearing on 19 April 2017. This action allows the Agency time to consider petitions for reconsideration of the RMP Amendments and take further regulatory action, as appropriate, which could include proposing and finalizing a rule to revise or rescind these amendments. The effective date of the rule amending 40 CFR part 68 published at 82 FR 4594 (13 January 2017), as delayed at 82 FR 4594 (26 January 2017) and 82 FR 13968 (16 March 2017), is further delayed until 19 Feb 2019.
