Department of Defense Pays Additional Penalty for Failing to Complete Settlement at Fort Wainwright, Alaska
The U.S. Army at Fort Wainwright in Fairbanks, Alaska has paid the U.S. Environmental Protection Agency a stipulated penalty of $87,000 for failure to complete the terms of a signed Resource Conservation and Recovery Act, Consent Agreement and Final Order (CAFO).

The CAFO, signed in December 2017, addressed several violations of hazardous waste generator regulations. In addition to paying a $35,000 penalty and certifying that the violations had been corrected, the Army committed to undertaking  a Supplemental Environmental Project (SEP).  With a SEP, a violator voluntarily agrees to undertake an environmentally beneficial project related to the violation,  and in return, the penalty is mitigated. SEPs further EPA's goal of protecting and enhancing human health and the environment, but do not include activities a violator must take to return to compliance. 

 

In this instance, the Army agreed to undertake a SEP consisting of two pollution prevention projects on the base, including one to recycle hazardous and non-hazardous antifreeze waste and one to utilize an advanced system for depressurizing waste aerosol cans.

 

In August of 2018, Fort Wainwright's Garrison Commander asked EPA to terminate the agreed upon SEP since Fort Wainwright would not be able to complete it in accordance with the CAFO.  The Army paid the stipulated penalty in full in September 2018.
