Administration announced new actions by more than 20 agencies to bolster the Federal Government's resilience to the worsening impacts of climate change. These actions are detailed in annual agency adaptation progress reports and highlight an Administration-wide commitment to confronting the climate crisis by integrating climate-readiness across every agency's mission and programs.

Section 112(r) of the Clean Air Act requires owners/operators of a stationary source that manufactures, uses, stores, or otherwise handles more than a threshold quantity of a listed regulated substance in a process, to implement a risk management program and submit a single RMP for all covered processes at the facility.

The Biden-Harris Administration is authorizing the use of the Defense Production Act (DPA) to accelerate domestic production of clean energy technologies. Specifically, the President is authorizing the Department of Energy to use the DPA to rapidly expand American manufacturing of five critical clean energy technologies: Solar panel parts like photovoltaic modules and module components; Building insulation; Heat pumps, which heat and cool buildings super efficiently; Equipment for making and using clean electricity-generated fuels, including electrolyzers, fuel cells, and related platinum group metals; and Critical power grid infrastructure like transformers.

This 1991 memo includes factors that DOJ considers important in evaluating whether to prosecute environmental violations. These factors include voluntary disclosure of the violation, cooperation, preventative measures and compliance programs, persuasiveness of non-compliance, internal disciplinary action, and subsequent compliance efforts. It was the intent of DOJ to encourage self-auditing, self-policing, and voluntary disclosure of environmental violations stating that these activities are considered mitigating factors in the Department's environmental enforcement activities. The necessity of having a thorough environmental auditing program cannot be overemphasized. The priority that DOJ assigns to auditing and self-disclosure as critical mitigating factors in environmental criminal prosecutions is an indication of how important it is for federal facilities to develop and implement sound and thorough auditing programs.

PHMSA hosted a webinar to present the objectives of the FAQ initiative and answer questions from concerned parties. The overarching concern expressed in comments was that PHMSA may eliminate the LOI process and rescind its existing LOI. During the public webinar, PHMSA clarified that the FAQ initiative compliments the LOI process and that PHMSA has no intention of discontinuing the process to request LOI, rescinding the nearly 7,000 LOI in its database, or limiting the scope of questions PHMSA will answer in the future. The Federal Acquisition Certification in Contracting (FAC-C) Modernization Memo was issued by the Office of Federal Procurement Policy (OFPP) on Jan. 19, 2023, with the goal of modernizing the Federal Acquisition Certification in Contracting (FAC-C). Beginning on Feb. 1, 2023, the new framework will transform how contracting professionals are managed and trained to support the federal procurement mission. The modernized FAC-C framework includes a refreshed contracting competency model, a single-level certification, updated certification requirements and the introduction of credentials which are mission-focused training packages. The new single-level FAC-C (Professional) requirements include completion of foundational training, one year of experience, a professional certification exam and an updated continuous learning requirement.

DoD, GSA, and NASA are withdrawing the proposed rule to amend the Federal Acquisition Regulation (FAR) titled: Disclosure of Greenhouse Gas Emissions and Climate-Related Financial Risk. Executive Order 14030, directed the Federal Acquisition Regulatory Council to consider amending the Federal Acquisition Regulation (FAR) require major Federal suppliers to publicly disclose greenhouse gas emissions and climate-related financial risk and to set science-based reduction targets. A proposed rule was published on 14 November 2022. The agencies lack sufficient time during the Biden-Harris Administration to finalize the proposal. In addition, the agencies' analysis of public comments indicates an evolving practices and standards in industry, and an evolving domestic and international regulatory landscape. Accordingly, this proposed rule is withdrawn, and the FAR case is closed. The proposed rule published on 14 November 2022, at 87 FR 68312 is withdrawn as of 13 January 2025. Office of Federal Procurement Policy, DoD, GSA, and NASA (collectively referred to as the Federal Acquisition Regulatory Council) are issuing a final rule amending the Federal Acquisition Regulation (FAR) to revise the list of domestically nonavailable articles under the Buy American statute. Part 23 details the environmental and occupational safety aspects of Federal Acquisitions. This includes Sustainable acquisition policy, energy and water efficiency and renewable energy, the use of recovered materials and biobased products, contracting for environmentally preferable products and services, and ozone depleting substances and greenhouse gases.

Part 52 Contains the required contract clauses for biobased product certification, affirmative procurement, recovered material certifications, EPA-designated item recovered material content, energy efficiency, and service and construction contracts.

EPA, the U.S. Department of Agriculture, the U.S. Department of Health and Human Services and the U.S. Department of the Interior have agreed to improve coordination and collaboration on issues related to pharmaceuticals in drinking water through a new memorandum of understanding. Under this agreement, federal agencies will share scientific data and information and coordinate potential future research on the presence of pharmaceuticals in drinking water, their sources and potential health effects.

Called Tox21, this collaboration merges federal agency resources (research, funding and testing tools) to develop ways to more effectively predict how chemicals will affect human health and the environment. Current partners in Tox21 include EPA, NIH, and FDA.

As part of the Obama Administration's initiative to reduce energy use, pollution and waste and save money in Federal operations, on 25 July 2014 Federal agencies released annual updates that show significant progress toward aggressive energy and sustainability goals set by the President in 2009. The Federal Government – the largest energy consumer in the U.S. economy – announced that it has reduced its greenhouse gas emissions by 17 percent since 2008, the equivalent of permanently taking 1.8 million cars off the road, and that 9 percent of Federal Government electricity is now from renewable sources.

The nation's top 50 purchasers are buying more than 11 billion kilowatt-hours (kWh) of green power annually, equivalent to the CO2 emissions that would be produced from the electricity use of more than 1.1 million average American homes. The U.S. Air Force is Number 8, the U.S. EPA is number 14, the U.S. Department of Energy is number 23. The U.S. Department of Veterans Affairs is number 30, and the U.S. General Services Administration/Region 2 is number 43 on the list.

WASHINGTON – Federal agencies today released the seven draft reports required by President Obama's executive order on the Chesapeake Bay, which contain a range of proposed strategies for accelerating cleanup of the nation's largest estuary and its vast watershed. The draft reports collectively call for increased accountability and performance from pollution control, habitat protection and land conservation programs at all levels of government, including an expanded use of regulatory authorities to address pollution control and additional voluntary and market-based solutions – particularly when it comes to habitat protection and land conservation programs. Federal agencies are also proposing new ways to harness the latest innovations in science and technology. The proposed actions are in response to overwhelming scientific evidence that the health of the Chesapeake Bay remains exceptionally poor, despite the concerted restoration efforts of the past 25 years.

The Bioeconomy Initiative: Implementation Framework was developed by the federal Biomass Research and Development (BR&D) Board. The Bioeconomy Initiative is a multi-agency strategy to accelerate innovative technologies that harness the nation's biomass resources for affordable biofuels, bioproducts, and biopower. The Framework will serve as a guiding document for the BR&D Board member agencies to increase government accountability and accelerate innovative and sustainable technologies that contribute to a secure, reliable, affordable, and enduring supply of U.S. energy and products.

(WASHINGTON, Dec. 16, 2015) – In support of the Obama Administration's Climate Action Plan, the U.S. Department of Energy (DOE), the U.S. Environmental Protection Agency (EPA), and U.S. Department of Agriculture (USDA) jointly released the Biogas Opportunities Roadmap Progress Report today, updating the federal government's progress to reduce methane emissions through biogas systems since the Biogas Opportunities Roadmap was completed by the three agencies in July 2014. Today's report highlights actions taken, outlines challenges and opportunities, and identifies next steps to the growth of a robust biogas industry.

FEMP is excited to alert all interested in energy savings performance contracts (ESPCs) that eProject Builder is now fully active in production mode. While FEMP continues to improve the functionality, the system has passed out of the development stage and is fully capable of accepting new projects. eProject builder (ePB) produces ESPC task order schedules and provides a secure online system for easily accessing, tracking and reporting ESPC project data through the life of the contract for your portfolio of projects. Most of the work required in the form of data entry is done by the ESCO, as with the current TO and proposal process.

In celebration of Hydropower Day on August 24, the U.S. Department of Energy's (DOE) Office of Energy Efficiency and Renewable Energy, Department of the Interior Bureau of Reclamation, and the Department of the Army through the U.S. Army Corps of Engineers signed a new Memorandum of Understanding (MOU) to enhance collaboration and leverage resources to ensure the continued strength of the federal hydropower fleet. Hydropower plays a critical role in the U.S. power system, as both a source of renewable, affordable energy and as a firm, flexible resource that ensures the reliability of the grid. This MOU builds on previous work between the agencies to support American hydropower through long-term coordination, prioritize similar goals, and align ongoing and future renewable energy development efforts.

On 31 October 2014 Federal agencies released their plans for reducing their greenhouse gas emissions and preparing for climate change impacts such as flooding, sea level rise, severe weather and temperature extremes. The current agency Climate Change Adaptation Plans build on the first set of plans, which was released in February, 2013, and respond to a November 2013 Executive Order on Preparing the United States for the Impacts of Climate Change that established requirements for updating and reporting on progress on agency Adaptation plans.

The Federal Hazardous Waste docket contains certain information about Federal facilities that manage hazardous waste or from which hazardous substances have been or may be released.

CERCLA Section 120(c) requires EPA to establish and maintain this docket which contains information about Federal facilities that manage hazardous waste or from which hazardous substances have been or may be released. SARA, as amended by the Defense Authorization Act of 1997, specifies that, for each Federal facility that is included on the docket an evaluation shall be completed in accordance with a reasonable schedule. Such site evaluation activities help determine whether the facility should be included on the National Priorities List (NPL) and provide EPA and the public with valuable information about the facility. CERCLA requires that the docket be updated every six months, as new facilities are reported to EPA by Federal agencies.

Section 8 of EO 13514, Federal Leadership in Environmental, Energy and Economic Performance required each Federal agency to develop, implement, and annually update an integrated Strategic Sustainability Performance Plan. The initial plan was submitted to CEQ by 2 June 2010. This plan prioritizes agency actions for achieving environmental, economic, and energy goals detailed in EO 13514.

May is quickly approaching, and communities across the country are preparing to celebrate National Bike Month. This year, the White House Council on Environmental Quality (CEQ) and the Pacific Northwest regions of the EPA and DOT are cranking up efforts to promote the Federal Bike-to-Work Challenge.

FEMP plays a key role in helping agencies understand and meet the federal building energy efficiency standards for agencies' new construction and major renovation projects. These standards include base building efficiency as defined in the CFR by subpart A of 10 CFR 433 and 10 CFR 435, commonly referred to as the "residential" and "commercial" rules, respectively. This also includes the Clean Energy Rule for qualifying projects as defined by subpart B of 10 CFR 433 and 10 CFR 435. The Clean Energy Rule supplements both the base commercial and residential rules, transitioning new buildings and major renovations away from on-site fossil fuel derived energy consumption. Projects meeting the cost thresholds that trigger compliance with the Clean Energy Rule must also comply with both subparts A and B of the energy efficiency standards by first designing an efficient building (per subpart A) and then optimizing the design to reduce or eliminate on-site fossil fuel usage (per subpart B).

This updated document reflects the requirements of the 5 December 2013 Presidential Memo on "Federal Leadership on Energy Management." The updated guidance clarifies the criteria for "metered buildings" subject to the requirements of Section 432 of the Energy Independence and Security Act of 2007 (EISA) (42 U.S.C. § 8253(f)(8)) and designates the Environmental Protection Agency's Energy Star Portfolio Manager as the sole benchmarking tool for Federal agencies to use in fulfilling the benchmarking requirements. The criteria and process for requesting non-disclosure of building performance for national security reasons are also described in the guidance.

This year's American Institute of Architects (AIA) Committee on the Environment (COTE) Top Ten Awards includes the Los Angeles Federal Courthouse, a LEED Platinum building, among the winners this year. Also placing in the Top Ten was the major renovation of The Renwick Gallery of the Smithsonian American Art Museum.

This law mandated GSA identify the core competencies necessary for Federal personnel performing building operations and maintenance, energy management, safety, and design functions to comply with requirements under Federal law. The core competencies identified shall include competencies relating to building operations and maintenance, energy management, sustainability, water efficiency, safety (including electrical safety), and building performance measures.

GSA has reported progress toward key sustainability goals in recent years across its buildings portfolio. In this report GSA's aggregated buildings portfolio data show it exceeded prior goals for energy efficiency, water efficiency, emissions reduction, and renewable electricity share in fiscal year 2021, however GSA officials cited lack of access to capital as a challenge it faces in meeting future federal sustainability goals. GSA officials said the scale and scope of the projects needed to achieve net-zero building emissions by 2045 will require resources beyond what has historically been available.

Through Buy Clean, the Federal Government will for the first time prioritize the use of American-made, lower-carbon construction materials in Federal procurement and Federally-funded projects, which will advance America's industrial capacity to supply the goods and materials of the future while growing good jobs for American workers.

The Federal Energy Management Program (FEMP) offers links to tools that can help agencies reduce energy use and meet federal laws and requirements. Tools include software, calculators, data sets, and databases created by the U.S. Department of Energy and other federal organizations.

Two federal entities will pay a fine and enhance how they manage underground storage tanks at a facility in Puerto Rico to settle a case with the U.S. Environmental Protection Agency (EPA). The Puerto Rico Army National Guard and the Army & Air Force Exchange Service will together pay a $69,000 fine and ensure the underground storage tanks at their Camp Santiago facility in Salinas, P.R. comply with Puerto Rico underground storage tank requirements. The Guard will also install a system to conserve water and reduce pollution at the facility, estimated to cost $670,000. These actions resolve complaints issued by EPA to the two entities in August 2008. An underground storage tank system commonly stores petroleum or hazardous wastes. There are about 625,000 systems nationwide, and they can harm the environment and human health if their contents are released.

The UFR Process provides federal agencies with opportunities to expedite environmental and historic preservation (EHP) reviews through enhanced coordination for all presidentially declared disasters. The Applicant Guide will assist Applicants, (i.e. state and local agencies, Indian tribes, small business owners, individuals) in complying with EHP requirements when multiple agencies may be involved in funding or permitting a disaster recovery project. It also outlines the type of information Applicants should submit to federal agencies to assist in expediting the EHP review.

The Office of the Federal Environmental Executive and the U.S. Environmental Protection Agency are pleased to announce the recipients of the 2009 Federal Electronics Challenge (FEC) Awards. The Symposium will be both an in-person and virtual gathering of federal agencies to provide existing and relevant environmental information to Federal representatives. This event was first offered in 2002 and hosted at the National Institutes of Health (NIH) facility. The main purpose is to encourage partnerships, sharing of information, and best practices amongst Federal facilities. The U.S. Postal Service, the U.S. Secret Service, the U.S. Architect of the Capitol, the National Park Service, and the Fort Myer Military Community have been cited by the EPA for primarily failing to test for fuel leaks from USTs. The inspections performed by EPA at these facilities were required by the Energy Policy Act of 2005, which mandated that all federal USTs, not inspected since December 1998, be inspected by the August 2007 deadline. In 2007, 11 UST violations at federal facilities in the U.S. were settled for a total civil penalty of $48,288. These enforcement actions prevented 72,775 gal of contaminants from release into soil and groundwater. In settlement agreements with EPA, the cited agencies neither admitted nor denied liability for the alleged violations, but did certify compliance with applicable UST regulations.
