Threatened Species Status for Eastern Black Rail

USFWS determined threatened species status for the eastern black rail (Laterallus jamaicensis jamaicensis) under the ESA. Accordingly, they list the eastern black rail, a bird subspecies known from as many as 35 States, the District of Columbia, Puerto Rico, Canada, Brazil, and several countries in the Caribbean and Central America, as a threatened species under the Act. The effect of this regulation will be to add this subspecies to the List of Endangered and Threatened Wildlife. They also finalize a rule under the authority of section 4(d) of the Act that provides measures that are necessary and advisable to provide for the conservation of the eastern black rail. They have determined that designation of critical habitat for the eastern black rail is not prudent. This rule is effective 9 November 2020.
