During EPA's 2016 fiscal year--which spanned October 1, 2015 to September 30, 2016--EPA enforcement actions secured $13.7 billion in investments by companies for projects to control pollution. EPA also secured enforceable commitments that ensure the proper treatment, storage and disposal of an estimated 62 billion pounds of hazardous waste. EPA has finalized revisions to the RCRA hazardous waste generator regulatory program proposed on 25 September 2015. These revisions include reorganizing the hazardous waste generator regulations to make them more user-friendly and thus improve their usability by the regulated community; providing a better understanding of how the RCRA hazardous waste generator regulatory program works; addressing gaps in the existing regulations to strengthen environmental protection; providing greater flexibility for hazardous waste generators to manage their hazardous waste in a cost-effective and protective manner; and making technical corrections and conforming changes to address inadvertent errors and remove obsolete references to programs that no longer exist. This final rule is effective on 30 May 2017.

EPA is releasing the final Geologic Sequestration of Carbon Dioxide Guidance. This guidance will assist permit applicants and owners or operators in submitting and managing the large volumes of information associated with Class VI geologic sequestration projects. The guidance identifies common file formats used for geologic data and technical reports and describes how Class VI permit applicants and owners or operators can use the Agency's electronic Geologic Sequestration Data Tool to meet the Class VI electronic reporting requirements throughout the duration of a Class VI project.

On 22 June 2016 President Obama signed Frank R. Lautenberg Chemical Safety for the 21st Century Act which amends the Toxic Substances Control Act (TSCA). According to EPA, this is the first major update to an environmental statute in 20 years. Check out the website for a copy of the Act, a summary of key provisions, and a Q&A. Additional material, including an Implementation Plan on activities that are required in the first year, will be posted in the coming days.

EPA has announced an agreement with the U.S. Army to close four illegal large capacity cesspools on Oahu and eight on the Big Island. The Army will pay a $100,000 fine, the first time EPA has imposed a civil penalty against a federal government facility for operating banned cesspools.

EPA's inspections at the Guam Shipyard facility in 2012, 2013 and 2014 documented illegal storage and improperly contained hazardous wastes. Guam Shipyard, which operated the facility where the violations occurred, will pay a penalty of $44,893 and the Navy will pay $80,680 to settle its violations. In addition, Guam Shipyard has agreed to spend an estimated $250,000 to $330,000 to remove the abandoned vessel the Guahan-I located on the shoreline of the Outer Piti Channel in Apra Harbor. Guam Shipyard is a contractor to the U.S. Navy, operating on leased federal land. The U.S. Navy also generated a portion of the hazardous waste stored at the Guam Shipyard facility. The wastes included discarded flammable liquids, waste battery acid, lead paint, zinc powder, fluorescent light bulbs, and oily rags. All of the hazardous waste has since been properly disposed.

These recorded web-based course modules cover most of the material presented during the live EPA NPDES WET courses provided to EPA regional offices and to the states. The U.S. Environmental Protection Agency (EPA) has announced its seven National Enforcement Initiatives for fiscal years 2017-2019, which focus on national pollution challenges where EPA's enforcement efforts will protect public health. For the next cycle starting on October 1, 2016, EPA will retain four of its current National Enforcement Initiatives, add two new initiatives, and expand one to include a new area of focus. The fiscal year 2017-2019 National Enforcement Initiatives are:
    1. Keeping Industrial Pollutants Out of the Nation's Waters (new initiative)
    2. Reducing Risks of Accidental Releases at Industrial and Chemical Facilities (new initiative)
    3. Cutting Hazardous Air Pollutants (expanded initiative) 4. Reducing Air Pollution from the Largest Sources
    5. Ensuring Energy Extraction Activities Comply with Environmental Laws
    6. Keeping Raw Sewage and Contaminated Stormwater Out of the Nation's Waters
    7. Preventing Animal Waste from Contaminating Surface and Ground Water.
EPA is expanding its initiative focused on reducing toxic air pollution by adding large storage tanks and hazardous waste facilities to its work to address public health threats.

(Washington, Dec. 16, 2015) – The U.S. Environmental Protection Agency (EPA) today released its annual enforcement and compliance results highlighted by large cases that reduce pollution, level the playing field for responsible companies, and protect public health in communities across the country. In fiscal year 2015, EPA secured record-setting hazardous waste, Clean Air Act, and Superfund settlements, and acted swiftly to win a large criminal plea agreement following a major coal ash spill, among other accomplishments. Additionally, EPA made significant progress on cases that will benefit communities well into the future, by pursuing a final settlement that puts billions of dollars to work restoring the Gulf and helping communities affected by the BP oil spill, and by launching an investigation against Volkswagen for illegally emitting air pollution from diesel vehicles.

(Seattle – December 8, 2015) The U.S. Environmental Protection Agency has reached a settlement with the U.S. Army for alleged violations of its hazardous waste permit at Fort Wainwright, Alaska. As part of the settlement, the Army has agreed to pay $59,220 in penalties for violations of the Resource Conservation and Recovery Act (RCRA).

The Army Corps of Engineers has agreed to pay $85,059 to settle EPA claims that it violated federal regulations meant to protect the public from hazardous chemicals at a research lab in Hanover, N.H., and it has taken action to improve the safety of its operations at the facility. EPA alleged that the Army Corps did not comply with "Risk Management Plan" regulations contained in the federal Clean Air Act in its handling of anhydrous ammonia at its Cold Regions Research and Engineering Laboratory in Hanover. This facility contains about 14,000 pounds of anhydrous ammonia in a closed-loop refrigeration process. Risk Management Plan (RMP) requirements help to protect communities, workers, and emergency responders from accidental releases of hazardous chemicals, including ammonia.

This one-hour webinar provides an introduction to EPA's Enforcement and Compliance History Online (ECHO) website. ECHO is a regularly updated resource, available to both internal and external parties that allows users to access detailed information including, but not limited to, the compliance status, inspection history, and pollutant discharges at any specific EPA-regulated site. ECHO focuses on Clean Air Act stationary sources, Clean Water Act dischargers, Resource Conservation and Recovery Act hazardous waste handlers, and Safe Drinking Water Act public water system. Webinar participants will learn how to work with all of ECHO's features and will gain understanding of a valuable resource that can enhance their understanding of monitoring and enforcement of environmental regulations. Anyone who does work involving EPA-regulated sites will benefit from learning about ECHO and its various features.

The intent of these revisions is to strengthen the 1988 federal underground storage tank (UST) regulations by increasing emphasis on properly operating and maintaining UST equipment. The revisions will help prevent and detect UST releases, which are a leading source of groundwater contamination. The revisions will also help ensure all USTs in the United States, including those in Indian country, meet the same minimum standards. This is the first major revision to the federal UST regulations since 1988.

EPA's Enforcement and Compliance History Online (ECHO) website has added a beta Air Pollutant Report and the option to search for facilities that have reported Risk Management Plans under the Clean Air Act. The Air Pollutant Report, which displays emissions data by facility from EPA's various reporting programs, is available from All Data and Air facility search results.

The 2015 MSGP requires operators to electronically submit notices of intent (NOIs), annual reports, notices of termination (NOTs), discharge monitoring reports (DMRs), and no exposure certifications unless the EPA Regional Office has granted the operator an electronic reporting waiver, in which case the operator may mail the paper forms. EPA requires existing dischargers covered under the 2008 MSGP to submit a new NOI for coverage under the 2015 MSGP using NeT-MSGP, instead of the Stormwater eNOI (SWENOI) system used for the 2008 MSGP. Existing dischargers are not required to submit a notice of termination to terminate coverage under the 2008 MSGP. If your facility no longer needs industrial stormwater permit coverage, you do not need to submit an NOI for coverage under the 2015 MSGP. However, you should terminate coverage under the 2008 MSGP electronically using the SWENOI system (if your original NOI was submitted electronically) or by submitting a paper notice of termination form.

This EO states that the Federal Government shall provide leadership in preserving, restoring and maintaining the historic and cultural environment of the Nation. Agencies of the executive branch of the Government shall: (1) administer the cultural properties under their control in a spirit of stewardship and trusteeship for future generations, (2) initiate measures necessary to direct their policies, plans and programs in such a way that federally owned sites, structures, and objects of historical, architectural or archaeological significance are preserved, restored, and maintained for the inspiration and benefit of the people, and (3), in consultation with the Advisory Council on Historic Preservation (16 U.S.C. 470i), institute procedures to assure that Federal plans and programs contribute to the preservation and enhancement of non-federally owned sites, structures and objects of historical, architectural or archaeological significance.

EPA has released ECHO Version 2.4, featuring updated Clean Air Act stationary source data and a tailored search interface. ECHO provides information about environmental inspections, violations, and enforcement actions for EPA-regulated facilities, like power plants, factories, and federal facilities. The information in ECHO is now updated weekly, compared to monthly in the old system.

Released on 5 May 2015, the Pesticides Dashboard will initially present three years of compliance and enforcement activity data on the regulated universe of pesticide-producing establishments, thus placing FIFRA compliance information at the fingertips of anyone with Internet access. Future screens will focus on compliance with the worker protection standards. On the dashboard, the public can view and download information about the number of pesticide-producing establishments, inspections, and the government response to these violations during the three most recent years. Data is presented for states, tribes, EPA regions, and the nation as a whole.

This action lists five flammable refrigerants as acceptable substitutes, subject to use conditions, in several end-uses: Household refrigerators and freezers, stand-alone retail food refrigeration equipment, very low temperature refrigeration, non-mechanical heat transfer, vending machines, and room air conditioning units. This action also exempts from Clean Air Act Section 608's prohibition on venting, release, or disposal the four hydrocarbon refrigerant substitutes listed in this action as acceptable, subject to use conditions, in specific end-uses. This 5-day course is designed for personnel involved with the investigation and remediation of uncontrolled hazardous waste sites and, to a lesser extent, response to an accident involving hazardous materials. It provides basic information needed to meet the forty hours training requirements of 29 CFR 1910.120 (e)(3)(i) Hazardous Waste Operations and Emergency Response (HAZWOPER). After completing this course, participants will be more knowledgeable in hazardous waste operations, team functions, personnel health and safety procedures, and operation of field monitoring equipment. This course is limited to personnel from EPA, other Federal agencies, Tribes, and State and Local Government, and is free of charge for them. Personnel not directly employed by a government agency (e.g. private industry or contractor) cannot be accepted into this course.
