FEMP recently presented its 39th annual Federal Energy and Water Management Awards. These annual awards honor federal personnel and highlight their outstanding achievements related to energy and water cost savings, optimized energy and water use, and distributed energy at our nation's federal facilities.

EPA is asking the public for input on potentially adding certain per- and polyfluoroalkyl substances (PFAS) to the list of chemicals companies are required to report to the agency as part of the Toxics Release Inventory (TRI). EPA's TRI is an important tool that provides the public with information about the use of certain chemicals by tracking their management and associated activities. U.S. facilities in different industry sectors must report annually how much of each chemical is released to the environment and/or managed through recycling, energy recovery, and treatment. TRI helps support informed decision-making by companies, government agencies, non-governmental organizations and the public. Currently, no PFAS chemicals are included on the list of chemicals that are required to be reported to TRI.

WASHINGTON (November 20, 2019) Today, the U.S. Environmental Protection Agency (EPA), along with the rest of the federal government, released the Fall 2019 Unified Agenda of Regulatory and Deregulatory Actions and Regulatory Plan (Fall Regulatory Agenda and Annual Regulatory Plan), which provides updates to the public about regulatory activity. "EPA's Fall Regulatory Agenda and Annual Regulatory Plan continue to advance the agency's core mission of protecting human health and the environment through regulatory reform and modernization," said EPA Administrator Andrew Wheeler. "Under President Trump, EPA has finalized 47 deregulatory actions, saving Americans nearly $5 billion in regulatory costs. By creating a climate of regulatory certainty, we're able to breathe new life into local economies around the country." EPA's Fall Regulatory Agenda includes information on the agency's regulatory and deregulatory activities under development within the next 12 months. The Agenda includes 56 actions that are expected to be deregulatory and 37 actions appearing for the first time. The Annual Regulatory Plan includes EPA's statement of regulatory priorities and additional information about 34 priority actions that the agency plans to propose or complete in the coming year.

This handbook provides an overview of the federal hazardous waste regulations and helps small-business owners and operators understand how best to comply with federal hazardous waste management regulations. It was updated in October 2019 to incorporate new requirements from the 2016 Hazardous Waste Generator Improvements Rule, the 2018 e-Manifest Rule, the 2019 Hazardous Waste Pharmaceuticals Rule, and other recent rulemakings.

The U.S. Department of Energy (DOE) recognized 28 individuals and teams across the federal government for exceptional energy and water cost savings at the 2019 Federal Energy and Water Management Awards. This year's winners include those serving in the U.S. Air Force, Army, Defense Logistics Agency, Marine Corps, and Navy; the departments of Agriculture, Commerce; Energy, Interior, Justice, and Veterans Affairs; and the National Aeronautics and Space Administration. Many of the winning efforts focused on improving the federal government's energy efficiency and resilience through optimized operations and replicable cost-effective projects.

E-Manifest User Fees for October 1, 2019- September 30, 2021 Are Now in

EPA announced a settlement with the Department of the Navy for improperly managing hazardous waste at the Naval Air Weapons Station in China Lake. Under the agreement, the federal facility will pay a $23,700 penalty. The Naval Air Weapons Station - China Lake is in the Western Mojave Desert region of California, approximately 150 miles north of Los Angeles. Operations at the facility include research and development of explosive materials and weapons, aircraft maintenance, facilities maintenance operations, metal fabrication operations, and storage of hazardous materials and waste. EPA's 2018 inspections identified violations of Resource Conservation and Recovery Act (RCRA) regulations. RCRA rules require the safe management of hazardous waste to protect public health and the environment and to prevent the need for costly and extensive cleanups. Violations identified during the inspection included: Failure to comply with a permit condition that requires deteriorating containers to be replaced or put inside larger containers in good condition at the point of generation. Failure to keep hazardous waste containers closed. Failure to properly manage universal wastes. The facility has resolved the identified violations and is now in compliance with the RCRA requirements.

WASHINGTON (August 21, 2019) -- The U.S. Environmental Protection Agency (EPA) recognizes federal facilities for conserving resources and saving taxpayers' money as part of the Federal Green Challenge (FGC). The challenge is a national effort under the EPA's Sustainable Materials Management Program, which encourages federal agencies to lead by example in reducing the federal government's environmental impact. The pace of cleanup at federal facility Superfund sites can be delayed when Federal Facility Agreement (FFA) parties continue disputes beyond the agreed-upon dispute resolution timelines specified in negotiated FFAs.However, because disagreements and disputes are fact-specific, a fluid rather than a one-size-fits-all process may at times be necessary. This memorandum sets out principles clarifying and reinforcing the importance of adhering to agreed-upon FFA informaland formal dispute timelines. These principles support Recommendation 18 of the Administrator's Superfund Task Force Recommendations report, released on July 25, 2017.

WASHINGTON (June 19, 2019) – The U.S. Environmental Protection Agency (EPA) has issued the final Affordable Clean Energy (ACE) rule – replacing the prior administration's overreaching Clean Power Plan (CPP) with a rule that restores the rule of law and empowers states to continue to reduce emissions while providing affordable and reliable energy for all Americans.

As part of the U.S. EPA's July 25, 2017, Superfund Task Force Report (Report) Recommendation 30, EPA revised its 1997 "Policy Towards Landowners and Transferees of Federal Facilities." Recommendation 30 directed the revision as part of the Report's Goal 3, "Encouraging Private Investment." Formerly, the 1997 policy indicated that prospective purchaser agreements would not be necessary for landowners and transferees of federal facilities. In addition, it did not encourage the use of various tools, such as comfort letters, to give transferees confidence that EPA would generally not take CERCLA enforcement action against them. The revised policy is intended to encourage reuse and redevelopment of federal property. It supports the use of tools such as comfort letters and other agreements to address potential liability concerns of landowners and transferees who acquire federal property, and aims to alleviate uncertainty regarding potential enforcement by EPA for contamination existing as of the date of property acquisition. EPA developed the policy in coordination with two state organizations, ECOS and ASTSWMO, and other federal agencies. Susan Bodine, EPA's Assistant Administrator for the Office of Enforcement and Compliance Assurance, issued the revised policy on May 17, 2019. See attachment.

The Green Electronics Council (GEC), the organization that manages the EPEAT ecolabel, recognized the 2019 EPEAT Purchaser Award winners at an evening celebration held on May 22nd in Portland, Oregon. Fifty-nine organizations, including cities, states, US Federal agencies and companies from around the globe were honored for their decision to purchase sustainable IT products.

Through participation in the Better Buildings Initiative more than 900 public and private sector organizations have saved nearly 1.4 quadrillion British thermal units (Btus) of energy since the program began. This is a savings of nearly $8.5 billion and more than 80 million tons of CO2. Partners also have reduced their water use by more than 6.5 billion gallons.

EPA and the Army are proposing a new definition of "waters of the United States" that clarifies federal authority under the Clean Water Act. This new definition, when finalized, would replace the 2015 definition. The agencies will take comment on the proposal for 60 days after publication in the Federal Register. EPA and the Army will also hold an informational webcast on 10 January 2019, and will host a listening session on the proposed rule in Kansas City, KS, on 23 January 2019. When published, the link to the Federal Register official version of the proposed definition will be found in the "Regulatory Watch" section of Fedcenter.gov.

This report is published in response to mandates established in The Global Change Research Act of 1990. The Fourth National Climate Assessment (NCA4) fulfills that mandate in two volumes. This report, Volume II, draws on the foundational science described in Volume I, the Climate Science Special Report (CSSR) [issued in 2017]. Volume II focuses on the human welfare, societal, and environmental elements of climate change and variability for 10 regions and 18 national topics, with particular attention paid to observed and projected risks, impacts, consideration of risk reduction, and implications under different mitigation pathways. The National Oceanic and Atmospheric Administration (NOAA) served as the administrative lead agency for the preparation of this report. A Federal Steering Committee, composed of representatives from U.S. Global Change Research Program (USGCRP) agencies, oversaw the report's development.

Los Alamos National Laboratory (LANL) and Lawrence Livermore National Laboratory (LLNL) have received USDA's Excellence in BioPreferred Procurement Awards for Fiscal Year 2018 for testing and adopting biobased products within their operations. The U.S. Army at Fort Wainwright in Fairbanks, Alaska has paid the U.S. Environmental Protection Agency a stipulated penalty of $87,000 for failure to complete the terms of a signed Resource Conservation and Recovery Act, Consent Agreement and Final Order (CAFO).

U.S. Environmental Protection Agency (EPA) presented its first annual "National Federal Facility Excellence in Site Reuse" award to the former McClellan Air Force Base, in Sacramento County, in recognition of exemplary work transforming the Superfund site into a successful business park. The 3,452-acre McClellan Business Park now supports more than 17,000 jobs and has generated $580 million in public and private investment.

Integrated Pest Management (IPM) is a science-based, sustainable decision-making process that uses information on pest biology, environmental data, and technology to manage pest damage in a way that minimizes both economic costs and risks to people, property, and the environment. This is the first update since 2013 and is the culmination of a yearlong review by the Federal Integrated Pest Management (IPM) Coordinating Committee (FIPMCC), a joint effort that is coordinated by the Office of Pest Management Policy in the Office of USDA's Chief Economist with representatives of all federal agencies with responsibilities in IPM research, implementation, or education programs. These agencies include Environmental Protection Agency (EPA), Department of the Interior (DOI), and Department of Defense (DoD).

U.S. Environmental Protection Agency (EPA) announced an agreement with the U.S. Forest Service (USFS) to close 62 campground pit toilets, considered to be large capacity cesspools, at seven national forests across California. USFS, an agency of the U.S. Department of Agriculture, will have until December 2020 to comply with the federal Safe Drinking Water Act's ban on large capacity cesspools (LCC). USFS will be closing 62 pit toilets in seven national forests across California: Angeles, Eldorado, Inyo, Los Padres, Plumas, Sierra, and Tahoe National Forests. USFS has estimated the costs to close and remove the non-compliant systems and install new toilets is over $1.1 million dollars. The agreement also includes specific reporting requirements and allows for penalties should USFS fail to meet deadlines.

The Green Electronics Council (GEC) has launched a mobile phone module, the first in a series of expansions and updates to the existing EPEAT Environmental Benefits Calculator, to support public and private sector purchasers in calculating the environmental benefits of purchasing EPEAT registered mobile phones. The mobile phone module of the EPEAT Environmental Benefits Calculator helps organizations quantify impacts such as reductions in energy use, greenhouse gases and water consumption, as well as cost savings. The EPEAT Environmental Benefits Calculator results can be used by organizations as part of their CDP and GRI reporting.

The Bureau of Reclamation has settled federal hazardous waste handling violations with the U.S. Environmental Protection Agency at Grand Coulee Dam in Northeastern Washington. The Resource Conservation and Recovery Act (RCRA) violations discovered during EPA's 2017 inspection included: failure to conduct weekly inspections of hazardous waste accumulation areas; improper container management and failure to follow waste labeling requirements; improper hazardous waste storage (beyond 180 days) without a permit; violations of used oil and universal waste management requirements; and failure to make a hazardous waste determination. The waste in question included ignitable and corrosive compounds, used oil, mercury light ballasts and lithium batteries. As part of the Consent Agreement and Final Order with EPA, a $115,500 penalty was assessed. None of the violations outlined above occurred in publicly accessible areas.

The Federal Energy Management Program (FEMP) sponsors the annual Federal Energy and Water Management Awards to recognize individuals and organizations for significant contributions to energy and water efficiency within the federal government. Winners come from the Air Force, Army, Navy, VA, DOE, CDC, DHHS, DOI, and multiple other agencies.

The Federal Energy Management Program's (FEMP) annual FEDS Spotlight recognition program was presented at the 2018 Energy Exchange. The 2018 winners are being recognized by agency leaders and peers as federal champions who are working hard to implement exceptional projects and programs that help agencies achieve missions and meet energy, water, and fleet management goals. The Spotlight recipients and their achievement can be found on the website.

Federal agencies continue to demonstrate progress and performance on energy efficiency and sustainability. The Office of Federal Sustainability website has been updated with the FY17 sustainability progress data, agency OMB Scorecards, and the list of agency Chief Sustainability Officers.

In the U.S. District Court for South Carolina Judge David C. Norton issued an injunction against the EPA and Army Corps of Engineers' "Suspension Rule" that delayed the effective date of the Clean Water Rule for 2 years. The result of this injunction is to essentially reinstate the Clean Water Rule (26 June 2015, Federal Register) in 26 states; the remaining states are subject to district court injunctions currently blocking implementation of the Clean Water Rule.

This new SFTool section is dedicated to integrative design and collaborative construction practices. Construction project teams using integrative design approaches and collaborative practices save time and money by reducing the number of hand-offs between the design team and builder, creating a sense of mutual trust among the project team, and increasing stakeholder partnerships throughout the project. The new section presents real-world examples from GSA capital construction projects featuring four project role perspectives and how they used collaborative strategies to deliver high-performance buildings on time and on budget.

In this June 2018 study GSA compares 100 GSA high-performance buildings to 100 GSA legacy stock buildings looking at actual performance data in five key metrics from the last three years. The comparison found that high-performance buildings save energy, save water, cost less to operate, produce less waste, and have more satisfied occupants compared with typical buildings.

The streamlined process showcased in the video supports President Trumps One Federal Decision Memorandum of Understanding signed by 12 federal agencies in April directing the establishment of a coordinated and timely process for environmental reviews of infrastructure projects. The video also underscores EPAs goal to reach permitting-related decisions within 6 mo by 30 September 2022. The video was developed by EPAs Smart Sectors program, which works with the aerospace industry and 13 other sectors of the economy to better understand the challenges and opportunities surrounding regulated industries.

EPA's e-manifest system will officially launch in June 2018. The system will facilitate the electronic transmission of the uniform manifest form, which accompanies shipments of hazardous waste. As a result of the testing period and test user lessons learned the Fact Sheets for the various users (generators, transporters, tsdfs, etc) have been updated.

Eleven years ago the U.S. Senate's unanimous approval and designation of a week in June as "National Pollinator Week" marked a necessary step toward addressing the urgent issue of declining pollinator populations. Pollinator Week has now grown into an international celebration of the valuable ecosystem services provided by bees, birds, butterflies, bats and beetles. This year, June 18 – 24, 2018 is the designated week. Check out the Pollinator Partnership website for events and resources.

On 14 June 2018 EPA recognized federal facilities for conserving resources and saving taxpayers' money as part of the Federal Green Challenge (FGC). These efforts across the federal government have not only resulted in approximately $22 million in cost savings in the last year, but also further the goals of the President's17 May 2018, EO Regarding Efficient Federal Operations.

The Green Electronics Council (GEC), the organization that manages the EPEAT ecolabel, announced its 2018 EPEAT Purchaser Award winners on May 14th at a ceremony in Minneapolis, MN. The awards program honors organizations that show leadership in the procurement of sustainable IT products. This year's awardees include national and local governments, financial institutions, healthcare organizations, K-12 schools, institutions of higher learning, and businesses from around the globe. Multiple federal agencies were honored across the product categories: PCs and Displays, Imaging Equipment, Mobile Phones, and Televisions.
